What are the rehire rules under the ACA?
The ACA’s break-in-service rules decide whether a rehired worker is a new hire or a continuing employee. A break of at least 13 consecutive weeks (26 for educational organizations) lets the employer treat them as new; shorter breaks generally mean continuing status.
