If an employee returns after 13+ weeks (or 26 for schools), they may be treated as a new hire. Shorter breaks may require reinstating coverage with no waiting period.

If there’s a court order to add a child to a group health plan, can the employee enroll outside of open enrollment?
Yes. A court order qualifies as a special enrollment event, allowing the employee to enroll themselves and the child outside of open enrollment if required by the order.
