Short answer: Every employer with a group health plan must give the notice every year to each employee living in a state that offers Medicaid or CHIP premium assistance, enrolled or not. Texas is on the list.
The federal rule is tied to where the employee lives, not where the employer is located, and it reaches every employee in those states, not just people eligible for or enrolled in the plan. The point is to reach employees whose families might use state help to afford the employer coverage.
The Department of Labor publishes a model notice with each participating state’s contact information; the version current as of July 31, 2026 lists Texas Medicaid’s Health Insurance Premium Payment (HIPP) program. The employer may send it with plan eligibility materials, open enrollment materials, or the summary plan description.
Simplest practice for a Texas employer: include DOL’s current model notice in every open enrollment packet and new-hire packet for all employees.
