Can a deployed employee’s spouse and kids stay on the company health plan?

Short answer: Yes. USERRA continuation covers the employee and their dependents if the plan offers dependent coverage, for up to 24 months from the start of the absence.

The USERRA continuation right covers the employee ‘and dependents if the plan offers dependent coverage.’ The same 24-month limit and the same cost caps apply (regular employee share for service under 31 days; up to 102% of the full premium for 31 days or more).

If the family also has TRICARE because of the service member’s orders, the employer plan remains primary: TRICARE pays after other health insurance such as an employer-sponsored plan. The family should tell the TRICARE contractor and their doctors about the other coverage so claims are filed in the right order.

Whether to keep the employer plan, drop it, or keep it for some family members is the family’s choice; walk them through the network, the premium and the reinstatement rules for when the employee returns.
